Will of William Horobin 1749-1825

In the Name of God Amen, the fifteenth day of March 1823, I William Horobin of Crowdicote in the Parish of Hartington and County of Derby, Yeoman, do make and ordain this my last Will and Testament, that is to say, principally and first of all, I Will that my Body be buried in a decent christian manner at the discretion of my Executors hereafter mentioned; The Expenses of my Funeral and Probate of this my Will to be paid by them out of my personal Estate. And as touching such Goods and Estates wherewith it has pleased God to bless me in this life, I give, devise and dispose of the same in the form and manner following:

Imprimis: I give and bequeathe to my eldest son William, the sum of five shillings.

Item: I give and devise to my son John Horobin all that Parcel of Land at Hurdlow both the old and new inclosures in the Parish of Hartington and County of Derby to him and to his Assigns forever.

In the next place, I give and devise to my youngest son Daniel, his Heirs, Executors, Administrators and Assigns forever the Estate at Sheen Moor Top in the Parish of Sheen in the County of Stafford. I also give and devise to my son Daniel, his Heirs, Executors, Administrators and Assigns forever the whole Tithe of Whitle Farm in the Parish of Sheen and County of Stafford.

Item: I give and devise to my son Daniel that Parcel of Land on Sheen Moor called Smithy Closes and Heaths in the Parish of Sheen and County of Stafford to him, his Executors, Administrators and Assigns forever.

Item: I give and devise to my son Benjamin the Estate at the back of Sheen Hill in the Parish of Sheen and County of Stafford, his Heirs, Executors, Administrators and Assigns forever: But I will, ordain, constitute and appoint that my son Benjamin aforesaid, his Heirs, Executors, Administrators and Assigns, shall pay out of the said Estate at the back of Sheen Hill in the Parish and County aforesaid to my daughter Elizabeth Goodwin, six pounds per annum during her natural life.

And I also Will, ordain, constitute and appoint that my son Benjamin aforesaid, his Heirs, Executors, Administrators and Assigns shall pay out of the aforesaid Estate at the back of Sheen Hill to my son John one hundred pounds, twelve months after my decease.

Item: I give and devise to my son Benjamin, his Heirs, Executors, Administrators and Assigns, seven acres of Land at Sheen Hill.

Item: I give and devise to my daughter Elizabeth Goodwin a Parcel of Land on Sheen Moor Race in the Parish of Sheen and County of Stafford called the New Piece or Middle Piece, to her, her Heirs, Executors, Administrators and Assigns forever.

Item: I give to my daughter Ann Doughty, her Heirs, Executors, Administrators and Assigns the sum of three hundred pounds.

Item: I give and bequeathe to my daughter Hannah Needham the income or interest of two hundred and forty pounds for her own use, to be paid her half yearly by my Executors hereafter named, for and during her natural life and after the decease of my aforesaid daughter Hannah Needham, I give, devise and bequeathe the said Principal of two hundred and forty pounds to the surviving children of my said daughter Hannah Needham to be equally divided amongst them, share and share alike.

Item: I give and bequeathe to my grand daughter Ann Clowes her Heirs, Executors, Administrators and Assigns the sum of fifty pounds.

Item: I give and bequeathe to my grand daughter Susannah Goodwin when she arrives at the age of 21 years the sum of fifty pounds. Should my grand daughter Susannah Goodwin die before she arrives at years of maturity then I give and bequeathe the said sum of fifty pounds to my daughter Elizabeth Goodwin her Heirs, Executors, Administrators and Assigns.

Item: I give and bequeathe to my son Thomas six of the best milk cows, one horse and cart and gearing, one plough and harrow.

Item: I also give and bequeathe to my sons Benjamin Horobin, Thomas Horobin, John Horobin and Daniel Horobin all the residue and remainder of all my cash bills and book debts whatsoever and wheresoever, to be equally divided amongst them share and share alike. I also give to my four sons aforesaid all the residue and remainder of my farming stock, implements of husbandry, and household furniture to be equally divided amongst them, share and share alike.

Item: I constitute and ordain and appoint that all the Legacies mentioned in this my Will be paid by my Executors out of my personal Estate twelve months after my decease. And if any persons mentioned in my Will be discontented or dissatisfied with his or her Bequest, then I give, devise and bequeathe the money or property of the discontented party amongst the other persons mentioned in my Will to be equally divided amongst them, share and share alike.

I constitute and appoint my three sons Thomas Horobin, John Horobin and Daniel Horobin sole Executors of this my last Will and Testament ratifying and confirming this and no other to be my last Will and Testament. In Witness whereof I have hereunto set my hand and seal the day and year above written. The interlineations being made at the time above mentioned.

Signed, sealed, published and declared by the said William Horobin as his last Will and Testament in the presence of us the subscribers who at his request and in the presence of each other have put our names as Witnesses thereunto.

Daniel Horobin being duly sworn as that the personal Estate of the deceased will not amount in value to the sum of 1000 pounds. Testator died 1825.

At Hartington 18th June 1825, Let a probate of this Will be granted to Daniel Horobin, of Nab End in the Parish of Alstonefield in the County of Stafford, one of the Executors, reserving a power for Thomas Horobin of the Parish of Hartington, farmer, and John Horobin of Sheen, farmer, the other Executors to prove in like manner.
