Will of John Morewood 1645-1682

In the name of God Amen the Ninth day of Aprill in the Foure and thirtieth Yeare of the Raigne of our Soveraigne Lord Charles the Second by the grace of God of England Scotland France and Ireland Kinge Defendor of the Fayth the Anno & Dom One thousand six hundred Eighty & two. I John Morewood of Wormhill in the Parish of Tidswall and County of Darby Nowe beinge weak in body but of sound & perfect memory (praised bee God for the same) And being desirous to sett things in order before I dye Doe make this my last will & Testament in manner & Form Following That is to say, First & principally I Commend my soul to Almighty God my Creator hopeing to be saved by the precious merrits of Jesus Christ my saviour & Redeemer And my body to the Earth from whence it was taken to be buryed in such decent manner as to my Executrix hereafter named shall bee thought Fitt & Convenient. And as touching my worldly estate which God of his mercy hath sent mee my will & meaning is the same shall be employed & bestowed as hereafter by this my last will is expressed. And First I doe hereby revoke renounce Frustrate & make voyde all wills by me formerly made And doe declare & appoint this to be my last will & testament Item I give devyse & bequeath unto Anne Morewood my dearest and beloved wife and to her heires & assignes for ever All that Messuage or dwelling house situate standeing & beinge in Buxton in the sd County of Darby wherein one John Gamble now dwelleth and one Stable thereunto belongeinge togather with the Garden & Croft Lyeing on the North Syde of the sayd house and one barne called the Duglach barne in Buxton Le Green togather with the yard lyeing on the South Syde thereof And all those Two Closes Comonly called or knowne by the names of the new closes Lyeing & being neare unto a certayne parcel of Comon or wast ground called the Geldfeild And alsoe one other close called the Stonegapp close And alsoe two other closes called the Sherbrooke Closes lyeing & being neare to a certayne peice of comon or wast ground called the Coate heath and all houses outhouses buildings wayes waters priviledges proffits comons Comodities heriditaments appurtenances whatsoever to the same or any of them belongeing or apptayning All wch sayd Tenements & premises are situate lyeing & beinge within Buxton aforesayd & Buxton Le Green or one of them or within the Feilds Liberty precincts & Territories of the same And also all those two closes comonly called or knowne by the names of the two Nayly Irons And also all those two other closes Comonly called or knowne by the names of the old feilds knowles the which sayd closes tenements & premises last mencioned are lyeing & beinge in Stadon in the sayd County of Derby (and were all formerly purchased by mee of & from Anthony Norton late of Stadon aforesayd yeoman and Andrew Norton his son & heire apparent) to have and to hould the sayd Messuage tenements & premises with theire & every of theire appurtenances unto the sayd Anne Morewood my wife her heires & assignes for ever upon this Condition nevertheless that shee the sayd Ann Morewood my wife shall doe & Faythfully pay &discharge all such debts as I shall justly owe to any person or persons at the time of my death And that shee the sayd Ann Morewood my wife shall therewith Carefully mayntayne & Educate my daughters Sara Rebecca & Anne dureing theare minorities. Item I give devyse & bequeath unto my daughters Sara Morewood Rebecca Morewood & Anne Morewood and to theire heires & assignes for ever All those my two Messuages or dwelling houses situate standing & beinge in Stadon aforesayd called the over house wherein John Duckworth now dwelleth togather with all barnes stables outhouses & gardens thereunto belongeing And alsoe all that Messuage or Dwelling house wherein Edward Clayton now dwelleth togather alsoe with all those severall tenements peices or parcels of land & premises with theire & every of theire appurtenances situate Lyeing & being in Stadon aforesayd & hereafter particularly mencioned that is to say All those two croffts upon the East syde of the sayd Messuages last mencioned wherein John Duckworth & Edward Clayton now dwell And also the ? yard at the yards And all those two closes comon[ly] called or knowne by the name of the Crooked lands togather with the croft at the west end called the crooked lands end And alsoe two other closes called by the name of the three Roodes And also one halfe acre called the Steele land half acre And also two other closes called by the names of the great stone wall and the little stone wall And also One little croft lyeing at the south end of the little stone wall close And also one other close called the new close And also two closes or parcels of ? and called by the name of the Rotlands And alsoe an acre of land Lying in the How Meddow the Land of Ralph Needham at the east syde thereof And also two roodes of land lyeing in the bothom of the How Meddow And one halfe acre of Land called the Long Lands Togather with all wayes waters watercourses easements liberties priviledges proffits comons comodities hereditaments and appurtenances whatsoever to the sayd Messuages lands tenements & premises last mencioned belongeing or in any wise appertainynge To have & hould the sayd Messuages closes tenements peices & parcells of land & premises with theire & every of theire Appurtenances unto the sd Sara Morewood Rebecca Morewood & Anne Morewood my daughters theire heires & assignes for ever Provided always nevertheless & upon this Condition And it is my will & Mind That if John Morewood my son & heire doe well & truly pay or cause to be payd unto the sayd Sara Morewood Rebecca Morewood & Anne Morewood my daughters theire Executors or Administrators the full and just summe of Two Hundred pounds of lawful monye of England upon the Feast day of Saint Michaell the Archangell which shall be in the yeare of our Lord God one thousand six Hundred Ninty & two that then the sayd Devyse of the sayd Messuages barns stables outhouseing Closes tenements & premises ? soe made to the sayd Sara Morewood Rebecca Morewood & Anne Morewood my daughters shall be absolutely voyd & of noe effect And I hereby further declare my will & mind is that if the sayd John Morewood my son doe make default in payment of the sd summe of Two Hundred pounds [unto the aforesayd Sara] Morewood Rebecca Morewood & Anne Morewood upon the sd Feast day of Saint Michaell the Archangell which shall be in the yeare of Our Lord one thousand six hundred Ninety & Two then sayd John Morewood my son & his heirs shall have noe advantage or benefit of the sayd proviso or condicion but shall be barred & excluded from all relief of redemption & that the sayd Sara Morewood Rebecca Morewood & Anne Morewood my daughters & theire heires from thenceforth shall have hold & enjoye the sayd Messuages barnes stables outhouses closes Tenements peeces & parcels of land & premises with theire & every of theire appurtenances absolutely Freed & discharged off & from the proviso or Condition before mencioned And I doe hereby further declare my mind & will to bee that in case the sd Anne Morewood my wife shall happen to dye before the sd Feast day of Saint Michaell the Archangell which shall be in the yeare of our Lord One thousand six Hundred Ninty & two that then the rents issues & proffits of the sd Lands Messuages building closes Tenements & premises soe devysed to my sayd daughters Sara Morewood Rebecca Morewood & Anne Morewood as aforesayd shall be employed by the persons hereafter appoynted to be theire Guardians for the mayntainance & Education of my sd daughters untill the sayd Feast day of Saint Michaell the Archangell which shall bee in the yeare of our Lord One thousand six Hundred Ninety & two And if it happen the sayd Anne Morewood my sayd wife to dye before my children doe attayne unto the full age of one & twenty yeares in that onely Case I doe appoynt my trusty Loveing Freinds Thomas Poole of Hardingwood in the County of Stafford Gentleman And John Morewood of Nunn Feild in the County of Derby yeoman to be Guardians to my sayd Sonn John Morewood & alsoe to all my daughters untill they shall severally & respectively attayne to the age of one & twenty yeares And dureing that time to mayntayne & educate them according to theire discretion haveing respect to ? ? Item I give & bequeath unto my sayd Son John Morewood one Silver Bowle guilt one Silver Spoone one feather bed in the nether house parlor at Stadon & one Meale Arke in the ? chamber of the sayd house Item I give & bequeath unto my sayd daughter Sara Morewood one Silver Tumbler & one Silver Spoone Item I give & bequeath unto my sayd daughter Rebecca Morewood one Silver Sugar Sifter & one Silver Spoone Item I give & bequeath unto my sd daughter Anne Morewood one Silver Salt & one Silver Spoone. Item I give & bequeath unto my Brother Josiah Morewood all my Shirts Cloths Bootes & Showes Item I give and bequeath unto my sd Brother Josiah the summe of Forty Shillings of lawful monye of England to be payd to him within one whole yeare after my decease And as for & Concerning all the rest of my goods Catle & Chattels whatsoever & wheresoever (not herein before disposed of) I give & Bequeath the same to my sayd deare & Loveing wife shee payeing & dischargeing my Funeral charges & expences And payeing such debts as I shall justly owe at the time of my death And Mayntayning & Educating my sayd daughters according to the true intent of this my last will And Lastly I appoynt my Loveing wife Executrix of this my last Will & Testament And I doe hereby define & appoynt my Loveing Freinds & Kinsmen John Morewood of the Nunn Feilds yeoman And Robert Bagshaw of Hardingsbooth overseers of this my last will & testament. In Witness Whereof I have hereunto put my hand & seale the day & the yeare First above written.
