Summary of Will of Josiah Saunders Richardson 1753-1827

This is the Last Will and Testament of me Josiah Richardson Saunders of Ardwick Place within the Parish of Manchester, merchant

- all my debts, funeral expenses and the costs of my Will and Probate shall be first paid out of my Personal Estate with all convenient speed

- I direct that I be buried in a new vault near my father’s monument at Caverswall church in Staffordshire, and that a monument be erected over my body with a suitable inscription to my memory and a substantial iron palisading be placed round to preserve it from damage

- I bequeath £500 to Edward Loyd of Manchester, banker
Lewis Loyd of the city of London, banker
Joseph Richardson of Nunwick Hall, Westmoreland
in trust to pay
£100 to the Public Infirmary and Dispensary in Manchester
£100 to the House of Recovery in Manchester
£100 to the Lying in Hospital in Manchester
£100 to the School in Granby Row in Manchester for educating the poor £100 to the Manchester and Salford Auxilliary Bible Society

- I bequeath £20,000 in 3% Consols with interest on trust for my sister Mary Gould, and if she dies in my lifetime it goes to my trustees to accumulate until the husband of my niece Mrs Mary Gillum dies, or until her death, or in case they separate

and after her husband dies, and she survives both him and Mary Gould, to pay the interest on the Stock to Mary Gillum for life. But if she and her husband separate, it goes to her during the separation, free from control by her husband, but she must not dispose of it any way. If she died leaving children it is to go to supporting them until they reach 21 or marry

- I bequeath the same £20,000 Stock and interest equally to each child for when they reach 21 or marry if Mary Gillum is dead or when she dies, or if any child dies before reaching 21 unmarried then their share goes equally between the surviving children

but if Mary Gillum dies without leaving a child reaching 21 or marrying then it goes equally to

- I bequeath £500 to Ann Sewell wife of Joseph Sewell of Culgaith
£500 to Mary Ann Sewell, youngest daughter of Joseph and Ann Sewell
£2000 of Stock in 3% Consols to Joseph Richardson of Nunwick Hall
£500 of Stock in 3% Consols each to Misses Hannah Richardson and Sarah Richardson, the daughters of John Richardson of Culgaith
- I bequeath £2000 in 3% Consols to John Richardson late of Keswick in Cumberland (son of the late Paul Richardson of Culgaith and now residing with me) in addition to the contingent share of the £20,000 Stock should Mary Gillum die without issue

- I bequeath £5000 in the new 4% Reduced Stock to Paul Westmoreland of Culgaith, the brother of Thomas Westmoreland

- I bequeath £500 in the new 4% Reduced Stock each to Elizabeth Westmoreland and Jane Westmoreland, sisters of Joseph, Thomas and Paul Westmoreland

- I bequeath £500 in the new 4% Reduced Stock each to Mrs Mary Gedling and Mrs Sarah Benson, sisters of Elizabeth and Jane Westmoreland

- I bequeath £500 in the new 4% Reduced Stock each to John Richardson of Culgaith and his son Thomas Richardson

- I bequeath £500 to Mrs Richardson the wife of Joseph Richardson free from his control, she being able to dispose of it by will if she think proper

- I bequeath £200 each to Elizabeth Richardson and Holliday Richardson children of Joseph Richardson in trust payable to them at 21 years of age or when married, but if either die under 21 years and unmarried then the legacy of one goes to the other

- I bequeath £4000 to Edward Loyd, Lewis Loyd and Joseph Richardson on trust to buy Government Securities, paying the interest to Mary Gillum further to the previous provision during her life free from the control of her husband, but she must not dispose of it, and if she died leaving children then it goes to supporting them until they reach 21 or marry

- I bequeath £4000 and interest equally between the children of Mary Gillum attaining 21 years or being married (in addition to the previous provision) if Mary Gillum is dead or when she dies; and if any of them die under 21 or unmarried then their share is to be equally divided among the others; but if Mary Gillum dies without having children reaching 21 or married then when she dies the £4000 and interest is to be divided equally between Joseph Richardson, John Richardson (residing with me), Thomas Westmoreland and Thomas Richardson

- I bequeath to Mary Ann Sewell my gold watch with its chain, seals, key and attachments, and my profile [silhouette] set in gold

- I bequeath to my sister Mary Gould all my household goods, furniture, beds, bedding, plates, china, books, library, pictures (except the profile and gold watch), linen, wearing apparel, wine, liquors, spirits, horses, carriage, cart, silver watch, rings, brooches, and the cash in my house or on me when I die, and the victuals and provisions in my house when I die

- I direct that all my servants in my house and in my employ when I die shall each have “a decent Suit of Mourning” immediately given to them purchased by my executors

- I bequeath £10 to the Vicar of Caverswall and £2 to the Clerk of Caverswall church to be paid as soon as possible when I die

- I bequeath to the Vicar of Caverswall £10 more to be divided among parishioners he considers poor and proper objects of charity, but not more than £1 per person

- I direct that £39 8s 1d owing to Thomas Rogers (formerly my bookkeeper when he left my service) be paid to him and not more, that being all I believe to be owing him

- I bequeath £2000 to my trustees Edward Loyd and Joseph Richardson, £100 also to each, and a mourning ring worth £5 5s purchased by them

- I bequeath to Mary Ann Ricketts of Medford in Staffordshire now Lady St Vincent, to Mr Ricketts her husband now Lord St Vincent, and to Harriett the sister of Mary Ann Ricketts each a mourning ring worth £5 5s purchased by my Executors

- I bequeath £50 to John Walker of Manchester solicitor and a mourning ring worth £5 5s purchased by my Executors

- I bequeath my land in Ardwick adjoining Cook Street, all my other real estate, and my share in the premises in Mosley Street in Manchester called the Portico, and the rest of my personal estate not disposed of in my will in trust for Randle Richardson, the eldest son of my trustee Joseph Richardson

provided that he takes the surname of “Saunders” and bears the coat of arms of my family, and when he is 21 applies to the proper authority to have this duly registered
and in default Randle Richardson shall not benefit under my Will

and my Trustees are to sell the rest of my personal estate and put the money into Real or Government Securities until Randle Richardson is 21, and apply part or all of the interest for the education, and support of Randle Richardson until he is 21

but if he dies before that age without leaving any child or if he shall not take the name of “Saunders” nor bear the arms of my family, then all he would have received goes to his brother Holliday Richardson on the same condition, and in default he also shall not benefit under my Will

and what he would have received is to be divided and given as follows

one third to the children of Paul Richardson late of Culgaith deceased
one third to the children of John Richardson of Culgaith
one third to children of Joseph Westmoreland of Culgaith, shares of Mrs Mary Gedling and Mrs Sarah Benson being put into Securities, and interest paid to them free from control by their husbands, but they must not dispose of it any way

- I bequeath to Edward Loyd, Lewis Loyd and Joseph Richardson all the estate vested in me by mortgage in trust for any person to hold them for the purposes and subject to any right of redemption and to dispose of the property accordingly, but if any trustee shall die or wish to be discharged from or refuse or be incapable of acting, then my trustees can substitute another person in his place
and I revoke all former wills, and appoint Edward Loyd, Lewis Loyd and Joseph Richardson Executors of this my last Will and Testament

and when money come to their hands under this my will amounting to £100 or more, to deposit it in the Bank of Messrs. Jones Lloyd & Co. Manchester until it is put at interest on Real or Government Securities

but my Trustees and Executors shall be charged only with money they actually receive, and not be accountable for any loss except through their own fault, and one shall not be accountable for the acts of another
and they may reimburse themselves for their expenses

Codicil to the last Will and Testament of Josiah Richardson Saunders

I bequeath £400 Stock in the 3% Consols and a mourning ring worth
£5 5s to “my worthy friend” Lewis Loyd of London, banker

and £50 and a mourning ring of that value to John Lees of Manchester, merchant, my successor in trade

and £50 and a mourning ring of that value to William Parker of Ardwick, son of Colonel Parker now of Lancaster

The Will and Codicil were both duly signed resealed republished and redeclared by Josiah Richardson Saunders as his last Will and Testament and Codicil thereto, the name Edward Loyd being first written upon as an Erasure entirely throughout the said Will wherever the same occurs in the presence of us as witnesses 15 February 1827

Proved at London (with a Codicil) 18 March 1828 before the Judge by the oaths of Edward Loyd, Lewis Loyd and Joseph Richardson (the Executors) to whom administration was granted, having been first sworn Edward Loyd and Joseph Richardson (by Commission) and Lewis Loyd before the Worshipful Jesse Addams Doctor of Laws and Surrogate.
