Summary of the Provisions of the Will of John Gilbert 1794

I give my wife Lydia Gilbert her choice of the household goods and furniture
- £100 immediately
- £1,000 as required on giving the executors twelve months’ notice
- and a £400 annuity free of all costs and paid quarterly. (Should any of it be unpaid after 30 days, I give my wife Power of Recovery of the arrears from my chargeable real estate)

I give my son Robert Gilbert a quarter of my half share in a freehold property in Stanton in Derbyshire purchased from Richard Calton esquire, and a quarter of my interests in the black lead [[graphite], copper, “Lapis Calammaris” [[calamine or zinc carbonate] and lead mines leased in Cumberland, Westmoreland, Staffordshire, Derbyshire and Durham, and the smelting mills in Cumberland and Durham, while he continues my firm and interests therein, and he shall not be free to accept either of these bequests without accepting both
- and £4,000 to be paid within three years with interest at 4% per annum until payable

I give my granddaughter Alice Gilbert (daughter of my late son Thomas Gilbert) £600 payable when she is 24 or is married with the written consent of my wife or executors (whichever happens first) with interest at 5% per annum
- but if she dies under 24 unmarried (or married without consent and has no lawful children), then the legacy shall not be payable but goes to my residuary legatee
- but if she dies under 24 and married without consent and has lawful living children, then the legacy goes to her children equally

I give to the widow of my late son Thomas Gilbert an annuity of 52 guineas free from all deductions, payable to her weekly, monthly or quarterly as she requires

I give to Thomas Kent of Worsley £30 in token of regard for him

I give my son John Gilbert all the residue of my real and personal estates
- subject to paying all my debts, funeral expenses and probate costs, and if my personal estate is insufficient for them then they shall come out of my real estate (except my Glass House and premises in Liverpool),
- paying the £400 annuity to my wife
- and paying so much of the legacies (except that to the widow of my late son Thomas) as my personal estate shall be insufficient to pay

The provision made for my wife is to be accepted by her in full for the Jointure made by the Articles between us at our marriage, and also in full satisfaction of all dower she could claim

The provision made for my son Robert shall be accepted by him in full for all claims he could make under those Articles

My reasons for not providing for my grandson John Gilbert (son of my son Thomas Gilbert) or for his sister Lydia are that John enjoys his father’s real estate (which is much more than adequate to any provision I have made for his sisters), and that I have provided for Lydia by having given her husband Nathaniel Gould of Manchester merchant my Bond for £1,000 with interest

My reason for giving my granddaughter Alice Gilbert only £600 is that she does or will enjoy under the her maternal grandmother’s will so much property as will make that £600 more than adequate for the provision I have made for her sister Lydia Gould

I bequeath to Nathaniel Gould 100 Guineas in recompense for the trouble he may have in executing my Will

I hereby revoke all former Wills and Codicils and declare this my last Will and Testament

I appoint my son John Gilbert and Nathaniel Gould executors

Proved at London 5 October 1795 in the Prerogative Court of Canterbury constituted by the oaths of the executors John Gilbert and Nathaniel Gould to whom administration was granted.
