Will of Thomas Peake 1772

This is the last Will and Testament of me Thomas Peake of Lammas Coate near Stafford in the County of Stafford Yeoman made the third day of October in the year of our Lord one thousand seven hundred and seventy two as follows. I give and bequeath the Yearly Interest and Produce of the Sum of Four hundred Pounds now secured by a Mortgage of a Copyhold Estate late of Francis Roche Esqr deceased at Newnham in the Manor and Parish of Lindridge in the County of Worcester to my dear and loving Wife Mary Peake and her assigns for and during the term of her natural Life and from and after her decease I give and bequeath the said Sum of Four hundred Pounds unto my Nephews Samuel Peake Thomas Peake Francis Eld Peake (Sons of my Brother Samuel Peake) and Samuel Tunnicliffe to be divided amongst them their Executors or Administrators in equal Shares and Proportions Also I give and bequeath unto the said Francis Eld Peake the Sum of three hundred Pounds secured by a Mortgage of another Estate in the said County of Worcester the same to be paid and Payable to him at the time of my decease And I hereby direct my Executors hereinafter named to transfer the Security thereof to him accordingly and to release all such debts Sum and Sums of Money as shall be due and owing to me at the time of my decease from my said Nephew Samuel Tunnicliffe (if any such shall then happen to be unsatisfied) And all the rest residue and remainder of my Real and Personal Estate of what nature kind or quality soever or wheresoever (not herein before given and disposed of) I give devise and bequeath (subject to the payment of my debts and funeral Expenses) unto my said Wife Mary Peake her Heirs Executors Administrators and Assigns for ever and I hereby nominate constitute and appoint my said Wife Mary Peake and my Brother in Law Thomas Plant of Swinnerton in the said County of Stafford Gentleman Executors of this my last Will and Testament hereby revoking annulling and making void all former and other Wills by me at any time heretofore made In Witness whereof I have hereunto set my hand and seal the day and year first before written Thos. Peake Signed sealed Published and declared by the said Testator Thomas Peake as and for his last Will and Testament in the presence of us who attested the same at his request in his presence and in the presence of each other Mary Keen Thos. This Will was proved at London the eighth day of October in the year of our Lord one thousand seven hundred and seventy three before the Right Worshipfull George Hay Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Thomas Plant one of the Executors named in the said Will to whom Administration of all and singular the Goods Chattells and Credits of the deceased was granted having been first sworn by Commission duly to administer Power reserved of making the like Grant to Mary Peake Widow the Relict of the deceased and the other Executor named in the said Will when she shall apply for the same
